Terms of Service

The agreement governing your use of Nocta.ai Studio, your content and your account.

Provisional wording — final legal text requires review before launch. The contact, support, takedown, removal and appeal forms now send to an operations mailbox, but only where this deployment configures outgoing mail: each form states, after you submit, whether your request actually left the server, and issues a reference only when it did. Deleting an image from your Library Trash is the one erasure the product carries out itself; it never reaches the images generated from that asset, and the Privacy centre still simulates data export and account deletion without performing either.

Eligibility

The service is intended for users legally able to enter a contract. Minimum-age requirements depend on jurisdiction and will be confirmed during legal review.

Account creation and security

You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account and must notify us of suspected unauthorised access.

Using the service

Nocta.ai Studio lets you generate fashion imagery from your own source images. You are responsible for the inputs you upload and for having the rights to use them.

Features may evolve as the product develops; material changes will be communicated.

Credits, packs and subscriptions

Paid usage is measured in credits. The estimated cost is displayed before each generation, together with your balance and the balance after generation.

Only a server-confirmed operation can consume credits; a browser preview or an unavailable operation does not create a charge.

Payment and refunds

Payments and subscription management use hosted checkout and account-management surfaces operated by a third-party payment provider. A Checkout return alone never activates a plan or grants credits; the account changes only after verified payment confirmation.

Paid plans and top-ups are offered only when the current catalogue and Billing account state can be confirmed. If Billing is disabled or temporarily unavailable, purchase and account-management actions remain unavailable and existing credits are unchanged.

Uploaded content

You retain your rights in the images you upload. You must hold the necessary rights and, where a real person is depicted, their consent. See the Image and identity rights policy.

Generated content and ownership

Ownership and usage rights in generated outputs depend on applicable law and on the terms of the underlying model providers. The final ownership framework will be defined during legal review; generated outputs are not automatically guaranteed to be exclusively owned by the user.

Licence granted to Nocta

You grant Nocta a limited licence to host and process your uploads solely to operate the service, including processing by the selected generation providers.

Consent for depicted people

Editing images of real people requires their consent. Nocta may request confirmations before a generation and may block content where consent concerns arise. People depicted without consent can request removal without an account.

Prohibited use and moderation

Use must comply with the Acceptable use policy. Nocta may review, block or remove content and may suspend accounts for violations.

Suspension and termination

We may suspend or terminate access for material breach, fraud or legal necessity. You may stop using the service at any time.

Account deletion does not exist yet. The Privacy centre screen that offers it is a preview: it asks for your password and a typed confirmation, then deletes nothing. No other route in the product deletes an account either. Stopping use therefore leaves your account, your Library and your credit history in place — with one exception: assets you have already moved to Trash are erased 30 days later, whether or not you come back.

Service availability

The service is provided as-is during preview, without a guarantee of uninterrupted availability. Planned maintenance and incidents are communicated on the Status page.

Third-party providers

Generation and payment rely on third-party providers: image generation runs on Google and payments run on Stripe. Storage and authentication are operated on our own infrastructure. Every provider, and every category for which none has been selected yet, is listed on the Subprocessors page.

Limitations and disclaimers

To the extent permitted by law, the service is provided “as is”. Liability limitations will be defined during legal review.

Governing law and disputes

The governing law is to be confirmed before launch. The dispute-resolution process, including any mediation requirements, will be defined during legal review.
